1About this notice

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This notice applies to the health information created and held by Nova Capital Partners, LLC, doing business as Nova Health and Wellness Center at its Scottsdale clinic. It explains how that information may be used and shared, and the rights you have over it.

Care prescribed online is provided by a separate telehealth medical group, which keeps its own notice of privacy practices and gives it to you when you start a visit.

2How your information is used

Your health information is used and shared without needing your written authorisation for three ordinary purposes:

  • Treatment. So the team, and any clinician or pharmacy involved in your care, can plan and provide it. For example, your scan report is shared with the provider who builds your plan.
  • Payment. So the clinic can bill and be paid, and so a payment or financing provider can process a transaction you have authorised.
  • Health care operations. So the clinic can run itself: quality review, training, credentialing, audits and business management.

3Other uses the law allows or requires

Your information may also be used or shared, without your authorisation, where the law permits or requires it. That includes:

  • When required by federal, state or local law
  • For public health activities, including reporting disease, and to the FDA about a product
  • To report suspected abuse, neglect or domestic violence
  • For health oversight activities such as audits and licensure inspections
  • In response to a court order, subpoena or other lawful process
  • To law enforcement in the limited circumstances the law sets out
  • To a coroner, medical examiner or funeral director
  • For organ and tissue donation
  • For research, where an oversight board has approved it and privacy is protected
  • To prevent a serious and imminent threat to the health or safety of you or someone else
  • For specialised government functions, including military and national security
  • For workers’ compensation, as state law requires

4Uses that need your written permission

Some uses always need your written authorisation, and you can take that authorisation back at any time in writing. They are marketing, the sale of your information, and any use of psychotherapy notes beyond the narrow cases the law allows.

Anything not described in this notice is done only with your written permission.

5Your rights

You have the following rights over your health information:

  • To see and get a copy. Usually within 30 days. A reasonable, cost based fee may apply to copies.
  • To ask for a correction. If you think something is wrong or incomplete. The clinic may decline, and will tell you in writing why.
  • To get a list of disclosures. Covering the six years before your request, excluding those for treatment, payment and operations.
  • To ask for a restriction. On what is used or shared. The clinic does not have to agree, with one exception: if you pay in full out of pocket for a service, you can require that it is not shared with a health plan.
  • To be contacted another way. At a different number or address, if the usual one puts you at risk. Reasonable requests are accommodated.
  • To a paper copy of this notice. Even if you agreed to receive it electronically.
  • To be told about a breach. If your unsecured information is breached, you will be notified.
  • To name someone to act for you. A personal representative or someone with medical power of attorney can exercise these rights.

To exercise any of these, call the clinic on 480-307-9130 or write to the address below.

6The clinic’s duties

The clinic is required by law to keep your health information private, to give you this notice of its legal duties and privacy practices, to follow the terms of the notice currently in effect, and to tell you if a breach compromises the privacy or security of your information.

Your information is not used or shared for any other purpose without your written permission.

7Changes to this notice

This notice may be changed, and a change applies to information already held as well as to information created afterwards. The current version is always posted on this page and available at the clinic, and the date it took effect is shown at the top.

8Complaints

If you believe your privacy rights have been violated, tell the clinic first. Call 480-307-9130 or write to 7425 E. Shea Blvd, Suite 112, Scottsdale, Arizona 85260.

You may also complain to the Secretary of the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue SW, Washington DC 20201, by calling 1-877-696-6775, or at hhs.gov/ocr/privacy/hipaa/complaints.

You will never be retaliated against for making a complaint.

Exercising a right, or raising a concern

Ask for the privacy officer. Nothing you raise affects the care you receive.
